LEGAL NOTICE

back

In compliance with Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce, we hereby provide users with our contact information.

1. PURPOSE

Fundación Biodiversidad (hereinafter, the provider), as the entity responsible for the website, makes this document available to users to govern the use of the website:

www.cities2030.es

The purpose of this document is to comply with the obligations set forth in Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE or LSSI), as well as to inform all users of the website regarding its terms of use.

Through its website, Fundación Biodiversidad provides users with access to and the ability to use various services and content made available through the portal.

Any person who accesses this website assumes the role of user (hereinafter, the user), which implies full and unreserved acceptance of each and every provision included in this Legal Notice, as well as any other applicable legal provisions.

As users, you should carefully read this Legal Notice each time you visit the website, as it is subject to change. The provider reserves the right to modify any information that may appear on the website without any obligation to give prior notice or inform users of such modifications; publication on the provider’s website shall suffice.

2. TERMS OF ACCESS AND USE OF THE WEBSITE

2.1. Free access to and use of the website

Use of the Fundación Biodiversidad website is free of charge for all users.

2.2. User Registration

In general, the provision of the Services does not require Users to subscribe or register in advance. However, Fundación Biodiversidad makes the use of certain services contingent upon the User first completing the corresponding registration form. This registration must be completed in the manner expressly indicated in the relevant section of the service.

On the registration forms managed by Bureau Veritas, the first-layer consent clause will appear and will identify:

Data Controller: Fundación Biodiversidad
Data Processor: Bureau Veritas

2.3. Accuracy of the information

All information provided by the User must be accurate. To this end, the User guarantees the authenticity of the data provided through the forms used to subscribe to the Services. It is the User’s responsibility to keep all information provided to Fundación Biodiversidad permanently up to date so that it reflects, at all times, the User’s actual situation. In any case, the User shall be solely liable for any false or inaccurate statements made and for any damages caused to the provider or to third parties.

Minors

To use these services, minors must always obtain prior consent from their parents, guardians, or legal representatives, who are ultimately responsible for all actions taken by the minors in their care. The responsibility for determining the specific content accessed by minors lies with them. That is why, if minors access content that is inappropriate for the Internet, mechanisms—in particular software programs, filters, and blocking tools—should be installed on their computers to limit the available content. Although these are not foolproof, they are particularly useful for controlling and restricting the materials minors can access.

2.4. Obligation to Use the Website Properly

The User agrees to use the website in accordance with applicable laws and regulations, this Legal Notice, and generally accepted standards of morality and good conduct. In fact, the User shall refrain from using the website for any unlawful or prohibited purposes, or for purposes that infringe upon the rights and interests of third parties, or that in any way may damage, disable, overload, impair, or prevent the normal use of computer equipment or documents, files, and all types of content stored on any of the provider’s computer systems.

In particular, and by way of example but not limited to, the User agrees not to transmit, disseminate, or make available to third parties any information, data, content, messages, graphics, drawings, audio or image files, photographs, recordings, software, or, in general, any type of material that:

(A) is contrary to, undermines, or infringes upon the fundamental rights and civil liberties recognized by the Constitution, international treaties, and other applicable laws;

(B) induces, incites, or promotes criminal, defamatory, libelous, or violent conduct, or conduct that is generally contrary to the law, morality, and public order;

(C) induces, incites, or promotes discriminatory actions, attitudes, or thoughts based on sex, race, religion, beliefs, age, or status;

(D) violates a person’s right to honor, personal or family privacy, or personal image;

(E) in any way undermines the credibility of the provider or third parties; and

(F) constitutes unlawful, misleading, or unfair advertising.

Fundación Biodiversidad makes no warranties and shall not be liable, under any circumstances, for damages of any kind that may arise from:

  • The unavailability, maintenance, or malfunction of the website or its services and content;
  • The presence of viruses, malware, or harmful programs in the content;

Fundación Biodiversidad will keep these links posted until they are removed or suspended by the provider or the advertiser, and will not be held liable, even if these ads are indexed by search engines other than this website.

The provider is not responsible for the information and content stored, including but not limited to, in forums, chat rooms, blog generators, comments, social media, or any other medium that allows third parties to independently publish content on the provider’s website. However, in compliance with the provisions of Articles 11 and 16 of the LSSICE, the provider makes itself available to all users, authorities, and law enforcement agencies, and actively collaborates in the removal or, when necessary, the blocking of any content that may violate national or international law, the rights of third parties, or public morality and order.
